Digitized Data Return Policy

PLEASE READ THIS DOCUMENT CAREFULLY.


1. All sales are final:

Returns of product, other than with defect, are subject to a service fee or subject to a 20% restocking fee at prevailing market rate as determined by Digitized Data of Tulsa. All items purchased may be exchanged if product is found to be defective. Any item refurned and found to be in working condition will be subject to a $65.00 per hour service fee. Only items purchased thru our web site (www.digitizeddata.com) may be exchanged/returned subject to restocking and/or service fees.

2. 48 Hour Grace Period for Exchanges/Returns:

Exchanges/Returns are allowed, but only within the first 48 hours after receipt. Exchanges/Returns after this time period are at the complete discretion of Digitized Data of Tulsa and may incur a substantial fee. Digitized Data of Tulsa must be notified by email (customerservice@digitizeddata.com) or by phone (918)281-9831 within this time period.

3. $65.00/Hour Service Fee on working parts.

All items sent back for exchange must have been tested bad - BY A QUALIFIED TECHNICIAN - prior to returning the part. We will charge a service fee of $65.00 per hour should we find a returned item to be in working condition.

4. Please Give Details:

Please be as specific as possible when listing the reason for exchange. This will assist us in making a correct determination of whether the product is truly defective. (Examples: CD Rom Drive rattles and makes noises, but only after spinning for 5 minutes or more. Video card gives blue screen after 20 minutes)

5. "Damaged" Products:

Any dismantled, marked on or visibly defaced, "negligent"," intentional", "willful", and/or "malicious" damage to the merchandise product by the customer will VOID all warranties.

6. Fitness of Purpose:

Digitized Data of Tulsa cannot warrant any product as fit for any particular use or purpose. We strongly recommend customers evaluate a sample unit to determine by their criteria whether a product will work in their configuration. In the world of computers and electronics there are many products that may be incompatible with a certain brand or certain parts. In cases like this it is your responsibility to install the product into a standard application in which the part will work. We are unable to take parts back because they will not work in particular brand product if they function correctly in others. Customer acknowledges Digitized Data of Tulsa have not and do not make any representations or warranties of any kind or nature, directly or indirectly, express or implied, as to any matter whatsoever, including but not limited to, the suitability of the merchandise, its use for any particular purpose, its merchantability, its condition and/or its quality.

7. Customer is responsible for all shipping costs to Digitized Data of Tulsa .

8. Pack Returns Carefully:

Customer must pack defective items being returned as if they were new and working. Failure to do so may invalidate the warranty. Digitized Data of Tulsa is not responsible for goods that are damaged during shipment or misused/abused by the customer/carrier.

10. Expiration of Exchanges/Returns:

All exchanges/returns valid for 10 days after being issued. Digitized Data of Tulsa must receive product within this time period (other than international returns). ). If, after 10 days from the date of issue, merchandise is not returned, the merchandise will be considered non-exchangeable/non-returnable. Therefore no exchange and/or refund will occur.

Replacement items will be shipped back to Customers via USPS only. Priority, Express and Overseas shipping is subject to an additional cost to the customer.

11. Limitations of Liability/Indemnification:

Digitized Data of Tulsa liability in all cases, including but not limited to its failure to deliver Merchandise, shall be limited to the value of the merchandise only. Digitized Data of Tulsa may at it sole option choose to (1) replace/exchange the merchandise, or (2) refund the sums paid by the customer, which is potentially subject to a restocking fee, at the sole discretion of Digitized Data of Tulsa, equal to the prevailing market rate, as determined by Digitized Data of Tulsa, which shall at all times be at least 20% of the purchase price, less the charge for shipping and handling. Digitized Data of Tulsa shall have no liability for any special, incidental and/or consequential damages arising out of or in connection with the purchase and/or use of the product/merchandise. Customer must acknowledge at agreement of purchase to indemnify the company, its officers, employees, and agents from and against any and all losses, injuries, claims, demands and expenses of any kind arising from the purchase and/or use of product/merchandise.
